Privacy Statement
Yurban Rides Limited runs Yurban taxi-hailing application. To do this, and solely for the app functionality, the solution collects private customer data such as name, phone number and location. The application ensures that this information is secured in transit from the apps to our servers using HTTPS protocol, stored in secure servers and only accessed by the solution to deliver customer and driver experiences and hence maintaining the user privacy that is required. The location data in particular is only used to connect Customers with the Drivers and for purposes of offering taxi-hailing solution and not for any other purposes. Yurban does not share this information with any third-parties.
Terms and Conditions for Customers
Yurban Rides Limited is a private limited company incorporated in Kenya under the Companies Act of 2015. Yurban does not provide transportation services, transport services are provided by self-employed drivers using their own vehicles. Yurban connects drivers and their customers. Drivers are not employees of Yurban, they provide transport services on an independent basis.
To be allowed to use the Yurban App Platform, customers must first agree to the following terms and conditions:
- Customers must always use the Yurban App Platform in good faith for lawful purposes only.
- Customers are expected to always be respectful to Yurban drivers.
- When customers request for rides and they are accepted and then cancel them after 5 minutes, they are required to pay a cancellation fee which is the base fare for that category of vehicle.
- When drivers notify customers of their arrival at the pickup location and the customers fails to appear within 5 minutes, the ride requests will be deemed to have been cancelled and customers will be charged the cancellation fee (base fare).
- Customers are responsible for paying road tolls and airport surcharges.
- Customers decide whether to pay cash for their rides or to pay via the Yurban App Platform. If they pay via the Yurban App Platform, Yurban receives their payments and forwards them to the drivers. Yurban sends receipts for the rides to the phones of the customers via SMS.
- When customers pay their fares via Yurban App Platform, Yurban will not be responsible for any additional Safaricom charges. Safaricom may charge additional fees when processing payments of customers.
- Customers who ride Yurban Bodas are required by law to put on a helmet and a reflective vest which should be provided by the owners of the Boda Bodas. These should be returned to the owners at the end of the trip.
- Disputes that might arise are resolved between customers and drivers. Yurban provides support in resolving payment problems between customers and drivers.
- If drivers cancel customers ride requests after accepting them, Yurban will not be responsible. However, Yurban will investigate and if drivers are found to have cancelled rides without valid excuses, they will be censored.
- Once drivers arrive at their customers pick up locations and notify customers of their arrival, they will start charging fare after 5 minutes on a waiting time basis.
- If customers cancel several accepted rides within 12 hours without valid excuses, their accounts will be blocked for 7 days. If after reactivation the same behavior continues, their accounts will be blocked for 30 days. After the 30 days are over, they may request Yurban to reactivate their accounts. Each application will be considered on its own merits.
- If customers damage drivers vehicles or property, Yurban will not be responsible. That will be resolved by the drivers and their customers.
- Yurban will not be liable for any loss or damage that customers may incur as a result of using the Yurban App Platform.
- Yurban may terminate customers use of the Yurban App Platform if they breach any of these terms and conditions or if it considers it necessary to protect the safety of its drivers.
- Customers should rate drivers at the end of their rides. The ratings are anonymous and drivers do not receive names or phone numbers of the customers who provided the ratings. The ratings help Yurban to offer suggestions to the drivers for improving the quality of their services.
- Yurban retains the right to block accounts of customers if their activities are malicious or for refusing to pay their fares or for fraud or for being disrespectful towards
- If amendments are made to these terms and conditions, customers will be notified. If customers continue to use the Yurban App Platform, it will mean that they have accepted the amendments.
- The personal data of customers that Yurban collects includes name, phone number, geolocation when on rides, payment information, and information about disputes. This data is used to connect customers and drivers. Personal data may also be used in investigating and detecting fraudulent payments. Only the basic relevant personal data is disclosed to drivers.
Terms and Conditions for Drivers
Yurban Rides Limited is a private limited company incorporated in Kenya under the Companies Act of 2015. Yurban Rides provides Online information to drivers and customers, it does not provide transportation services. It connects drivers and customers.
To be allowed to provide Online transportation services using the Yurban Rides Apps Platform, drivers must first agree to the following terms and conditions:
- There is no employment agreement or employment relationship between Yurban Rides Limited and drivers who use its Online App Platform. There is also no joint venture or partnership between Yurban Rides and drivers. Drivers are not employees, agents or representatives of Yurban Rides Limited.
- Yurban Rides is an agent or broker that connects drivers and customers and is paid a fee or commission for its services. Drivers use their vehicles to provide transportation services independently as self-employed persons or as independent contractors. Drivers are their own bosses and have the right to determine whether to accept, decline or ignore ride requests, and when to work and when not to work.
- Before drivers are allowed to begin using Yurban Rides App Platform, they must sign up and provide the requested information and documents. By signing up, drivers agree that they have carefully read, understood and agreed to abide by these terms and conditions, and that all the information they have presented to Yurban Rides is accurate, correct and complete.
- Drivers also agree that they will not use the Yurban App Platform for unauthorized or unlawful purposes, and that they will at all times, comply with all relevant laws and regulations of Kenya.
- Drivers must always adhere to all traffic rules and regulations. Drivers (not Yurban) will be liable for any violations of the Kenyan laws and regulations when providing transportation services using the Yurban Rides App Platform.
- Drivers who use Yurban Rides App Platform must always have valid and current licenses, permits, insurance, registrations, certifications and any other documentation that is required by the laws and regulations of Kenya.
- Drivers are obliged to comply with all their Kenyan tax obligations that arise from providing transportation services using the Yurban Rides App Platform. These include, but are not limited to, income tax, NSSF and NHIF. If KRA or any other legal government entity submits a valid application to Yurban to provide information regarding drivers business activities, Yurban may make available to them the requested information if it is in accordance to the law.
- Yurban drivers must always provide transportation services in an ethical and professional manner in the interests of their customers. Drivers must always take the routes least costly for their customers unless customers request otherwise. Drivers should also not make any unauthorized stops on the way.
- Drivers should also not have other passengers in their vehicles except their customers and the passengers accompanying their customers.
- Yurban Rides will not be liable for any loss or damage that a driver may incur for using the Yurban App Platform. Yurban will also not be liable for the actions or non-actions of customers.
- If customers refuse to pay, Yurban Rides will try to collect the fares from the customers on behalf of the drivers. Yurban will not be obliged to compensate Drivers if customers refuse to pay their fares. Such customers will be suspended and will not be able to enjoy Yurban Rides App services until they pay what they owe drivers.
- Customers may pay Drivers for their rides by cash or via the Yurban App Platform. Yurban Rides will act as an agent of drivers to collect fares on their behalf that is paid via the Yurban App Platform. Yurban will deduct its fees/commission from fares paid via its App and disburse the rest to drivers.
- Customers will rate drivers at the end of their rides in order to guarantee high-quality services. If drivers rating are below the required minimum level, they will be given an opportunity to raise them up. If drivers do not increase their rating score to the required minimum level within a prescribed time period, their accounts will be suspended either temporarily or permanently. Yurban may reverse the suspension of accounts if it is merited by any external circumstances or if the suspension was caused by a system error or false ratings.
- These terms and conditions will become effective when drivers submit their signup applications and they are accepted and activated.
- Yurban may amend or terminate this Agreement at any time and for any reason. Drivers will be notified of any changes to this Agreement in a timely manner.
- This agreement will be governed and enforced in accordance to the laws of Kenya.
- Yurban Rides collects personal data for the purpose of connecting customers with drivers. Yurban displays drivers photos, names, vehicle details, phone numbers, and geolocation data for customers to identify drivers and their vehicles.
